Boy charged with fellow 10-year-old’s murder after taking gun from felon father’s car: cops – New York Post

A 10-year-old Sacramento boy shot and killed another 10-year-old with a stolen gun he found in his felon father’s car while retrieving a pack of cigarettes from the vehicle, authorities said.

Sacramento County Sheriff’s Deputies charged the youngster with murder and his father, Arkete Davis, 53, with multiple felonies including gun charges and child endangerment.

Davis was also hit with an accessory after the fact felony for allegedly trying to dispose of the gun in a trash can after the shooting.

Around 4:30 p.m. on Dec. 30, deputies responded to a call that a boy had been shot at an apartment complex in the Foothill Farms neighborhood. Upon arrival, they found an unresponsive juvenile in the middle of the parking lot “bleeding from his head and neck.”

Deputies attempted CPR until the Sacramento Metro Fire Department arrived and rushed the boy to a nearby hospital, where he was pronounced dead. The sheriff’s department later confirmed that the victim was just 10 years old.

Witnesses at the scene reported the shooter had fled to a nearby apartment. Deputies visited the apartment and detained Davis as well as two juveniles without incident.

As homicide detectives and crime scene investigators interviewed witnesses and combed the scene for evidence, they learned one of the detained juveniles, Davis’ 10-year-old son, had taken his father’s gun when he went out to get him a pack of cigarettes from the car.

The sheriff’s department said the boy had “bragged” to the victim that his father had a gun before shooting him one time and running back into the apartment.

Detectives later found the gun, which cops said was stolen in 2017, in a nearby trashcan, which they believe Davis had tried to hide.

According to public records reviewed by The Post, Davis has a lengthy criminal history of theft, fraud and felony drug charges dating back to 2011, with offenses in both California and Texas.

Due to his previous felony convictions, Davis was legally prohibited from owning or possessing a firearm.

Soon after the shooting, family members identified the deceased boy as Keith Frierson, affectionately known as KJ, to KCRA.

KJ’s aunt Erika spoke lovingly of her nephew as she placed flowers, balloons and candles around the parking lot in a makeshift memorial for the slain child Sunday.

“He was smart, very intelligent, kind, loving, respectful,” she told the outlet “He didn’t deserve this. He still had a whole life to live.”

She said KJ had just come outside to ride his bike when the tragic shooting occurred.

“He wasn’t even outside 15 minutes, and the little boy shot my nephew,” she said.

The alleged child gunman was arrested and taken to the Sacramento County Youth Detention Facility, where he was charged with murder. A sheriff’s department spokesperson said if the criminal case proceeds, the child could “theoretically” remain behind bars until he’s 25 if convicted.

Davis was also arrested and charged with felonies including carrying a stolen loaded firearm in a vehicle, possession of firearm by a felon, criminal storage of a firearm in the first degree, accessory after the fact and endangering the life or health of a child.

The sheriff’s department told The Post that although his fate is now in the hands of the courts, Davis “could be looking at very serious time based on his charges.”

He’s being held on $500,000 bail and is scheduled to appear in court Jan. 3.
